Case closure summary

29 May 2019: The purchase of MWR by Recycling Lives Limited was approved by the CMA and completed on 29 May 2019. This brings the merger investigation to a close.

Penalty notice

10 January 2019: The CMA has published a notice (dated 20 December 2018) of a penalty imposed on EMR and Ausurus under section 94A of the Enterprise Act 2002. The CMA imposed the penalty for a failure to comply, without reasonable excuse, with the requirements imposed by the initial enforcement order issued by the CMA under section 72 of the Enterprise Act 2002.

Invitation to comment: now closed

19 July 2018: On 4 June 2018 the inquiry group published its provisional findings that the transaction has or may be expected to result in a substantial lessening of competition in five markets. Since publication of those findings, the inquiry group has received additional evidence from industry participants. In light of this new evidence the inquiry group has now come to a different provisional finding to that originally consulted on, in relation to purchasing of ferrous and non-ferrous metal in London – the inquiry group now provisionally finds that no substantial lessening of competition is expected in that market. In order to consult on this new finding and the evidence that underpins it, we have today published a supplementary provisional findings document in relation to London.

27 November 2017: The CMA is considering whether it is or may be the case that this transaction has resulted in the creation of a relevant merger situation under the merger provisions of the Enterprise Act 2002 and, if so, whether the creation of that situation has resulted, or may be expected to result, in a substantial lessening of competition within any market or markets in the United Kingdom for goods or services.
