Final decision
The CMA’s final decision is to release merger undertakings given by British Sky Broadcasting Group plc in 2001. The undertakings are now no longer in force and will be removed from the CMA’s public register of remedies in force.

Decision to carry out a review
10 March 2023: Following a previous consultation, the CMA has decided to conduct a review of merger undertakings given by British Sky Broadcasting Group plc in 2001 following a transaction in which it increased its shareholding of British Interactive Broadcasting Holdings Ltd.
The purpose of this review is to determine whether, as a result of any change in circumstance, the undertakings given by Sky in 2001 are no longer appropriate and need to be varied, superseded or released. This review will not address any other matter relating to the business of Sky.
We’re now consulting on whether there has been a relevant change in circumstances which means that the undertakings should be varied, superseded or released. Visit the consultation page linked below for details of our launch decision and consultation.
Responses should be sent to us by 5pm on Friday 31 March 2023. We will then consider the views and evidence received before reaching and consulting on a provisional decision.
Case information
The CMA consulted on whether to launch a review of merger undertakings given by British Sky Broadcasting Group plc in 2001 following a transaction in which it increased its shareholding of British Interactive Broadcasting Holdings Ltd. This followed a request from Sky UK Ltd that the CMA reviews the undertakings. The invitation to comment was published on 30 January 2023 and closed on 17 February 2023. No responses were received.
