Consultation description

The Master of the Rolls has asked the Civil Procedure Rule Committee (CPRC) to review the Pre-Action Protocols (PAP).

The amendments will reflect the recommendations in the final report of Lord Justice Jackson reviewing litigation costs (Review of Civil Litigation Costs, Final Report 2010) and will clearly set out the consequences of non-compliance with the protocols.

The CPRC is taking the opportunity to update references and links, remove out of date sections and to include common sections such as a stocktake stage where appropriate in all the Pre-Action Protocols.

A subcommittee of the CPRC has prepared the draft of a new protocol, the Pre-Action Protocol for Debt Claims. This Protocol contains much of the information contained in the existing Pre-Action Protocol for Conduct which, once amended, will serve as the Pre-Action Protocol where no other suitable protocol is available.

The CPRC now invites written responses on the detail of the Pre-Action Protocol for Debt.
