Consultation on the Pre-Action Protocol for judicial review
Consultation description
The Master of the Rolls has asked the Civil Procedure Rule Committee (CPRC) to review the Pre-Action Protocol (PAP).
The amendments will reflect the recommendations in the final report of Lord Justice Jackson reviewing litigation costs (Review of civil litigation costs, final report 2010) and will clearly set out the consequences of non-compliance with the protocols.
The CPRC is taking the opportunity to update references and links, remove out of date sections and to include common sections such as a stocktake stage where appropriate in all the PAP.
A subcommittee of the CPRC has prepared the draft of a new protocol, the PAP for judicial review. The Home Office has recently conducted a consultation on a form for use in immigration and asylum cases and the consultation deadline for responses to that consultation is extended should parties wish to comment on both documents.
The CPRC now invites written responses on the detail of the PAP for judicial review.
