As a result of the responses received, we have:
- published our updated enforcement and sanctions policy and its annex 1
- adopted the proposed calculation method in line with the sentencing guideline for environmental offending

Consultation description
Following the Department for Environment, Food and Rural Affairs’ Strengthening environmental civil sanctions consultation, the Environment Agency want your views on how they propose to:
- remove the cap for variable monetary penalties in the Environmental Civil Sanctions (England) Order 2010 from its current amount of £250,000
- introduce powers to issue variable monetary penalties for the Environmental Permitting (England and Wales) Regulations (EPR) 2016
