This report examines the balance of competences between the United Kingdom and the European Union in the area of social and employment policy.

The Department for Business Innovation and Skills (BIS) led, and the Department for Work and Pensions (DWP), Health and Safety Executive (HSE) and Government Equalities Office (GEO) contributed to this report. It is a reflection and analysis of the evidence submitted, either in writing or orally, by:

  • experts
  • non-governmental organisations
  • businesspeople
  • Members of Parliament
  • other interested parties.

A literature review of relevant material is included.

Consultation description

The government is carrying out a review of the balance of competences between the UK and the EU. The review will provide an analysis of what the EU does and how it affects the UK. The Review of the balance of competencies detailed guide provides full details of the review programme.

The Department for Business, Innovation and Skills (BIS) is leading on the report on social and employment policy in the 3rd semester of the review. The social and employment review covers the main areas of regulation that affect the workplace:

  • non-discrimination
  • regulating the employment relationship
  • social protection
  • health and safety at work

It also covers those areas of competence that aim to improve coordination between Member States on social and employment issues.
