This report examines the balance of competences between the European Union (EU) and the United Kingdom (UK) in the area of free movement of services. It’s a reflection and analysis of the evidence, submitted either in writing or orally, by:
- experts
- non-governmental organisations
- businesspeople
- Members of Parliament (MPs)
- other interested parties
It also includes a literature review of relevant material. Where appropriate, the report sets out the current position agreed within the Coalition government for handling this policy area in the EU. It does not predetermine or prejudge proposals that either Coalition party may make in the future for changes to the EU or about the appropriate balance of competences.

We received a number of submissions to the free movement of services call for evidence. The submissions, which were received from a broad range of stakeholders, were either in writing or oral. We also conducted a literature review of relevant material.

The government is carrying out a review of the balance of competences between the UK and the EU. The review will provide an analysis of what the EU does and how it affects the UK. The Review of the balance of competencies detailed guide provides full details of the review programme.
The Department for Business, Innovation and Skills (BIS) is leading on the report on the single market and services in the 3rd semester of the review. The review of the single market and services will consider the freedom to provide services across the EU. It will cover:
- public and defence procurement
- company law
- mutual recognition of professional qualifications (MRPQ) issues
The review will also consider services covered by specific sectoral EU legislation (eg telecommunications, broadcasting, audiovisual), as well as those dealt with by the Services Directive (eg IT, construction, food and drink, hospitality and retail).
