The GCA received a range of responses from suppliers of different products and of varying business size to the consultation. Additionally there was a workshop with suppliers on the issue at the 2016 annual conference and a meeting with trade associations in the summer. Formal written responses were received from the ten regulated retailers and one trade association.

The investigation by the Groceries Code Adjudicator (GCA) into Tesco plc uncovered a range of practices relating to payments for better positioning of goods under paragraph 12 of the Groceries Supply Code of Practice (the Code). The consultation considers the proper scope of indirect requirements for payment to secure better positioning of goods or increased shelf space within a store.

Responses to this consultation will help the GCA understand how widespread these practices are among the 10 retailers regulated by the Code, what forms they take, their impact on suppliers and their effect on competition and consumer choice.
