The CMA has published its response to the consultation and updated guidance on its approach to market investigations. Paragraphs 50 to 87 of CC3: Guidelines for market investigations: Their role, procedures, assessment and remedies have been revised and incorporated into CMA3: Market Studies and Market Investigations: Supplemental guidance on the CMA’s approach.

Consultation description
The Competition and Markets Authority (CMA) is inviting views on its proposals to make changes to the way market investigations are undertaken in the future, and on proposed amendments to its published guidance on market investigations to reflect these changes.
The 2 proposals for consultation are to:
- streamline the market investigation process by considering remedies earlier; reducing the number of set-piece consultations; and earlier, flexible interaction with stakeholders
- increase efficiencies between market studies and investigations while maintaining independent decision-making
The CMA will hold a stakeholder roundtable event on 29 March to discuss these proposals. Further details are in the consultation document.
Following consultation, the Market studies and market investigations supplemental guidance (CMA3) will be updated to incorporate the revised guidance.
