Details

The claimant made three complaints alleging the union had breached its rules and the Trade Union and Labour Relations (Consolidation) Act 1992 (the 1992 Act) in relation to his request for access to the accounting records of the union. On 17 July 2013, the Certification Officer made an interloctuory decision (annexed to this decision) striking out the complaints of breach of rule and of section 30(6) of the 1992 Act. On 13 August 2013, the Certification Officer upheld the claimant’s remaining complaint of a breach of section 30(2)(a) of the 1992 Act. The Certification Officer did not consider it appropriate to issue an enforcement order.
