Details

Four complaints that the union had breached its rules in relation to the claimant’s suspension and one complaint that the union breached section 47(1) of the Trade Union and Labour Relations (Consolidation) Act 1992 by unreasonably excluding him from standing for election. The Certification Officer dismissed the breach of statute complaint and two of the complaints of breach of rule but found that the claimant had been suspended from office in breach of the union’s rules. He issued an enforcement order requiring the union to withdraw the suspension.
