Details

The claimant alleged that the union breached the 1992 Act in relation to the 2009 General Secretary Election. The Certification Officer declared that the union had breached section 50(1) of the Act by not according equally to all members of the Union the entitlement to vote in that election. He also declared that the Union had breached section 49(5A) (a) and section 52(5) by not supplying the scrutineer with a copy of the register of names and addresses of its members and by not issuing members with a required statement when notifying them of the result. The Certificate Officer refused the claimant’s application for a declaration that the Union had breached section 49(5) and section 52(4) of the 1992 Act. The Certification Officer made an enforcement order that the UCATT 2009 General Secretary election be treated as void and that Mr Ritchie shall forthwith cease to hold office as General Secretary.
