Energy Related Products Policy and Energy Technology List (ETL): privacy notice

This notice sets out how we will use your personal data, and your rights. It is made under Articles 13 and/or 14 of the UK General Data Protection Regulation (UK GDPR).
The data
We will process the following personal data.
- names and contact details of individuals, companies and their employees using or requesting information about the Energy Technology List (ETL) and the Energy Label Service
- names and contact details of individuals, companies and their employees involved in and contributing towards any consultations relating to the ETL, the Energy Label Service and Energy Related Product policy
- names and contact details of individuals, companies and their employees who have expressed an interest in Energy Related Products Policy to DESNZ or its contractors
- photographs, images, video interviews where stakeholders have given consent for processing for a specific purpose
We will also process the following information:
- names of companies using or requesting information about the Energy Technology List (ETL) and the Energy Label Service
- names of companies involved in and contributing towards any consultations relating to the ETL, the Energy Label Service and Energy Related Product policy
- Names of companies who have expressed an interest in Energy Related Products Policy to DESNZ or its contractors
- for ETL website users who agree to non-essential cookies, we will use Google Analytics to measure how you use the website (see Cookie Policy)
- for LinkedIn users, we use LinkedIn Insight to record when you visit the ETL website by clicking on an ETL advertisement in LinkedIn
Purpose
DESNZ will be processing your personal data to allow implementation of Energy Related Products policy, including the ETL Scheme. This will involve disclosure of the information to service providers contracted by DESNZ.
For photographs, images, video interviews, these may be used in all types of publications in any form without limitation including but not limited to film deliverables, sound deliverables, online digital including social media, websites, emails and newsletters, press releases, conferences, journalistic and other editorial purposes.
Legal basis of processing
The legal basis for processing your personal data is processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the data controller, such as the exercise of a function of the Crown, a Minister of the Crown, or a government department; the exercise of a function conferred on a person by an enactment; the exercise of a function of either House of Parliament; or the administration of justice. In this instance, it is to development and implementation of Energy Related Products Policy, including the Energy Technology List Scheme.
The lawful basis for processing photographs, images, video interviews and accompanying information is Consent. Should you change your mind and wish to withdraw consent you can contact the ETL Scheme at: [email protected].
Recipients
Your personal data will be shared with service providers contracted by DESNZ for delivery, administration, policy development, statistical, research and fraud prevention purposes. It may be shared by us with other government departments where we deem it necessary and appropriate. We may also share your data if we are required to do so by law, for example by court order or to prevent fraud or other crime.
In relation to this Privacy Notice, the service providers currently contracted by DESNZ are Fivium Ltd, ICF Consulting Ltd and Ricardo Ltd (including partner organisations and sub-contractors where applicable). Under those contracts, DESNZ is the Data Controller, and the service providers are the Data Processors. The Data Processors may share your personal data with each other where this is necessary to discharge their contractual duties to DESNZ.
Retention
The information you provide will be retained until it is no longer needed for the purpose or until the Energy Technology List Scheme is closed.
Automated decision making
Your personal data will not be subject to automated decision making.
Your Rights
You have the right to:
- withdraw consent at any time; contact details to withdraw consent are in Legal basis of processing
- request information about how your personal data is processed, and to request a copy of that personal data
- request that any inaccuracies in your personal data are rectified without delay
- request that any incomplete personal data are completed, including by means of a supplementary statement
- request that your personal data are erased if there is no longer a justification for them to be processed
- in certain circumstances (for example, where accuracy is contested) to request that the processing of your personal data is restricted
- object to the processing of your personal data where it is processed for direct marketing purposes
- object to the processing of your personal data
International Transfers
As your personal data is stored on our IT infrastructure and shared with our data processors Microsoft and Amazon Web Services, it may be transferred and stored securely in the UK and European Economic Area (EEA). Where it is the case that your personal data is stored outside the UK and EEA it will be subject to equivalent legal protection through the use of Model Contract Clauses.
Updates to this notice
If this privacy notice changes in any way, we will place an updated version on this page. Regularly reviewing this page ensures you are always aware of what information we collect, how we use it, and under what circumstances we will share it with other parties. The ‘last updated’ date at the bottom of this page will also change and the revision to the Privacy Notice will be recorded alongside the date of change. If these changes affect how your personal data is processed, we will take reasonable steps to let you know.
