This guidance is aimed at helping readers understand the permitting requirements of European Community (EC) Directive 1999/31/EC on the landfill of waste (“the Directive”).

This guidance is being published to help those regulating and operating landfill sites, but it will also be of interest to others concerned with landfill. It describes the views of the Secretary of State for the Department for Environment, Food and Rural Affairs (Defra) and the Welsh Assembly Government (WAG) on how the Landfill Directive should be applied and how particular terms should be interpreted in England and Wales.

This guidance replaces the Government Interpretation of the Landfill (England and Wales) Regulations 2002. The guidance explains the legal requirements but only the national or European Courts can give a definitive interpretation of the legislation.
