On 7 February 2013, the High Court quashed (rejected as invalid) 2 government decisions announced in 2013. They concerned the allocations of EU Structural Funds to the 4 countries of the UK and to the Local Enterprise Partnerships (LEPs) in England. The High Court quashed the decisions on the sole ground that government had not met the Public Sector Equality Duty (PSED) as part of the decision-making process.

The Department for Business, Innovation and Skills (BIS) has now undertaken a comprehensive equality impact assessment. It covers the potential effect of the proposed funding decision on areas of the UK, and in England in particular.

Having fully considered the potential implications of the PSED, BIS is satisfied that the original allocations of EU Structural Funds are still appropriate. BIS is also satisfied with the method used to make the allocations. On that basis, BIS is taking the decision to confirm those allocations of EU Structural Funds, as set out in the attached letter to MPs and Chairs of LEPs.
