Details

The Act has the following effect:

  • It restates that where a matter is significant or controversial and outside the scope of the current Programme for Government approved by the Assembly it must be referred to the NI Executive Committee;

  • It makes clear that the decision-making functions of the Department for Infrastructure and its Minister under the Planning Act (and regulations made under that Act), are the responsibility of that department and do not require Executive referral, with the exception of ‘planning policy’ which must continue to be referred to the Executive Committee; and

  • It redefines the definition of cross cutting to make clear that an issue only needs to go to the Executive Committee if it affects the statutory responsibilities (rather than interests) of one or more than one Minsters ‘more than incidentally.’
