Form N9: Ask for more time to file a defence ('acknowledgment of service')

Use this 'response pack' to tell the court you need 28 days (rather than 14) to prepare your defence, or if you wish to challenge the court’s jurisdiction.

Details

Form N9 is a ‘response pack’ or ‘acknowledgement of service’. It mentions other forms that you’ll need to send, depending on the type of claim.

Use Form N9A: Offer to pay money you owe to a claimant if you want to admit the claim or the amount claimed and/or you want time to pay a specified amount.

Use Form N9C: Admission (unspecified amount and non-money claims) if you want to admit:

  • the claim or the amount claimed, and/or you want time to pay an unspecified amount
  • a non-money claim

Use Form N9B: Make a defence or counterclaim: specified amount if you want to:

  • dispute the whole claim
  • make a counterclaim against the claimant

Use Form N9D: Make a defence or counterclaim: unspecified amount if you want to:

  • dispute a non-money claim
  • dispute a claim for an unspecified amount
  • make a counterclaim against the claimant

If you admit part of the claim use both Form N9A: Offer to pay money you owe to a claimant and Form N9B: Make a defence or counterclaim: specified amount.
