Guidance for local authorities on the using fixed penalty notices for breaches of the household waste duty of care. These were introduced under Section 34(2A) of the Environmental Protection Act 1990.

  1. Updated to set out what local authorities are allowed to use money from fixed penalty notices for, as the Waste Enforcement (Fixed Penalty Receipts) (Amendment) (England and Wales) Regulations 2024 come into force.

  2. The maximum full penalty for breaches of the household waste duty of care is now £600.
