Thank you for your email of 28 September in which you requested from the Insolvency Service:

“The full names of insolvent businesses in England & Wales and Scotland in SIC 35.14 re Trade of Electricity for Q1, Q2 and Q3 2020. Please provide a breakdown per quarter.”

Your request has been dealt with under the Freedom of Information Act 2000 (FOIA).

I can confirm the agency holds some of the information that you have requested.

The Insolvency Service holds information provided by Companies House covering the period Q1 to Q3 2020 (1 January to 30 September 2020). However, information held is on corporate body types that are regulated by the legislation relevant to Companies House. Companies House does not monitor all business types (e.g. sole traders) and for information on these and other business types you may wish to contact the Office of National Statistics: https://www.ons.gov.uk/.

Note that some of the information held is exempt from disclosure under section 22(1) of the act and the information is therefore refused.

Section 22(1) Information is exempt information if:

(a) The information is held by the public authority with a view to its publication, by the authority or any other person, at some future date (whether determined or not),

(b) The information was already held with a view to such publication at the time when the request for information was made, and

(c) It is reasonable in all the circumstances that the information should be withheld from disclosure until the date referred to in paragraph (a)

In applying this exemption, the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

Industry data held for Q3 2020 have been used to inform the following statistical releases to be published on the Gov.UK website:

While meeting the legal requirements of the FOIA, the Insolvency Service is also obliged under section 13 of the Statistics and Registration Service Act 2007 to continue to comply with the Code of Practice for Official Statistics, and specifically, the Pre-Release Access to Official Statistics Order 2008. The latter requires the producers of official statistics to ensure that no indication of the substance of a statistical report is made public or given to the media or any other party not recorded as eligible for access prior to publication. Note that Q3 data will be available for public release after 30 October 2020.

Annex A at the end of this letter provides names of corporate body types (as defined above) in the ‘Trade of Electricity’ sector that filed an insolvency with Companies House during Q1 and Q2 2020.

However, some caution needs to be taken when interpreting this information.

Companies were assigned to a sector (or industry) in line with the Standard Industrial Classification (SIC 2007) of economic activities (Standard industrial classification of economic activities: https://www.gov.uk/government/publications/standard-industrial-classification-of-economic-activities-sic) at time of registration at Companies House. However, a company may have changed its primary business since first registration, or the industry sector might be recorded as that of its holding company, and appear under “activities of holding companies” within the Business. The accuracy of this response relies on the coverage and accuracy of corporate bodies having been recorded with the following SIC code: 35140 Trade of Electricity.
