Details

The Board will direct release on the basis of the licence conditions that it considers to be appropriate. A panel will set the licence conditions it considers are required to manage risk. This guidance details the considerations members apply in order to set these lawfully and details what is necessary and proportionate in the interests of prevention of crime and protection of the public.

This has been revised to reflect:

  • The revised HMPSS Policy Framework on Licence Conditions Licence conditions Policy Framework - GOV.UK (www.gov.uk)
  • The Police, Crime, Sentencing and Courts Act 2022;

  • The amended Secretary of State 2022 Directions on transfer of indeterminate sentence prisoners to open conditions; and
  • The Parole Board Rules 2019 (as amended).
