Memorandum of Understanding between the UK Government, Scottish Government, Scottish Parliament and the Office of Communications

This Memorandum of Understanding (MoU) concerns the relationship between the UK Government, Scottish Government, Scottish Parliament and the Office of Communications (Ofcom)​,​ arising as a result of the Smith Commission Agreement and subsequent Scotland Act 2016.

Details

The MoU commits Ofcom to consulting on their draft annual plan by establishing a formal consultative role for the Scottish Government and the Scottish Parliament in setting the strategic priorities for Ofcom with respect to its activities in Scotland. Ofcom will also lay its annual report and accounts before the Scottish Parliament and submit reports to, and appear before, committees of the Scottish Parliament.

The MoU confirms that an appointment of a Member of the Ofcom Board shall be made by Scottish Ministers to represent Scottish interests, following consultation with the Secretary of State of the Department for Culture, Media and Sport, and sets out the process for doing so.
