NTE 2021/12: new dual-use regulation EU 2021/821

Regulation (EU) 2021/821 of the European Parliament and of the council of 20 May 2021 sets up a union regime for the control of exports, brokering, technical assistance, transit and transfer of dual use items. It was published in the Official Journal OJ L 206, on 11.6.2021. This came into force on 9 September 2021.
The Protocol on Ireland/Northern Ireland means that Regulation EU 2021/821 is directly applicable in Northern Ireland.
Any applications for the export of dual-use items submitted to ECJU from 9 September from Northern Ireland will need to comply with this regulation.
The key changes from the previous regulation (428/2009) are:
- new catch-all controls
- cyber-surveillance items
- national control lists
- 2 new EU General Export Authorisations (GEAs)
- intra group export of software and technology – exporters must have an Internal Compliance Programme in place to use this GEA
- encryption
- new controls on technical assistance including on military end -use
- more information exchange and transparency
- reference changes in line with the Lisbon Treaty
