Regulation 5 of the 2003 Regulations has been amended to allow officers who have been working on a part-time basis to return to working full-time within two months of giving written notice, if there is a suitable vacancy. In the absence of a suitable vacancy the officer will be appointed to a full-time post within four months of the written notice being received.

Regulation 26 of the 2003 Regulations is amended to allow officers to nominate days to be treated as public holidays. This is to allow implementation of recommendation 8 from Part 1 of Tom Winsor’s Independent Review of Police Officer and Staff Remuneration and Conditions (see Home Office circular 006/12).

The detail of this recommendation will be implemented in an amendment to the determinations, which will be published once the amended regulations are in force (22 November 2012).

Paragraph 7, sub-paragraph 3 of Schedule 3 to the 2003 Regulations is amended so that the replacement allowance that police officers have been receiving, based on previous entitlement to housing related payments, will not increase, regardless of changes in personal circumstances from 31 August 2011.

Regulation 11 of the 2003 Regulations is amended to cater for the situation where a senior officer is standing in for the chief officer of police at the time when the senior officer’s fixed term appointment expires.

The fixed term appointment of a senior officer who is standing in for the chief officer continues either until the senior officer is substantively appointed as chief officer, or until six months after the appointment of another person as chief officer.

In the latter case, the other person appointed as chief officer must then give the senior officer at least three months’ notice as to whether or not the appointment is to be extended when it eventually expires.
