On 1 October 2019, Cornwall Council made a formal application to the Marine Management Organisation (“MMO”) under Section 16 of the Harbours Act 1964 for a Harbour Empowerment Order (“HEO”). The Portreath, Portscatho and Portwrinkle Harbour Empowerment Order (“the Order”) makes Cornwall Council the statutory harbour authority for the harbours of Portreath, Portscatho, and Portwrinkle. The Order defines the harbour limits for each of the harbours.
The Order also amends the Cornwall Harbours Harbour Revision Order 2023 (“the HRO”) to include the harbours of Portreath, Portscatho, and Portwrinkle, allowing these harbours to be governed under the HRO. The Order also amends the HRO power to dredge to disapply the exemption contained in section 75 of the Marine and Coastal Access Act 2009 in respect of the harbours of Portreath, Portscatho and Portwrinkle, thereby not authorising any new works.

The Order does not authorise the construction or alteration of a project or confer development consent. Accordingly, no environmental statement was supplied.

The MMO approved the making of the Order on 20 June 2023, details of the decision-making process can be viewed in the Harbour Revision Order and decision report attached to this page. The Order will be laid before parliament on 26 June 2023 and will come into force on 17 July 2023.
