Details

You can appeal if:

  • your application has been refused;
  • a licence has been granted subject to conditions;
  • the Environment Agency has failed to determine your application within the specified period of time (or any extension agreed in writing);
  • the Environment Agency has failed to give notice within the specified period (or any extension agreed in writing) that the application has been referred to the Secretary of State in accordance with Section 41 of the Act.
