Payment including costs

If the defender pays the claim in full including the costs by cash, debit card or certified cheque before the expiry of the period of notice you should

  • bring the payment to account
  • complete the appropriate costs record as necessary
  • note the appropriate computer records.

Payment without costs

Where the defender pays the claim in full excluding the costs by cash, debit card or certified cheque before the expiry of the period of notice you should

  • bring the payment to account
  • complete the appropriate costs record to record the payment as necessary
  • note the appropriate computer records accordingly
  • make one application for payment of the costs

You must not seek decree for expenses alone.

Notifying the court

In each of the above instances you do not need to notify the court that payment has been received because as no minute for decree will be lodged the court will delete the case from its records.
