Welcome to November’s edition of the Local Authority Welfare Direct where you will find updates on a variety of topics. One item I would like to draw your attention to is the Move to Universal Credit update.

The issuing of migration notices and closure of legacy benefits as claims are made continues as we move into the second half of the financial year ending March 2025 when tax credits will close down. I would like to thank you all for your continued efforts in ensuring this process provides a smooth transition for our customers.

Before we get to March, we, of course, have the festive period and then you will no doubt be preparing for your annual billing and benefit uprating. I always remember managing that process in my early local authority career with weekend working and an endless amount of coffee involved. I wish you all well over the coming months and into 2025.

Importance of ensuring Housing Benefit interest markers on Searchlight are kept up to date 

1. A small number of local authorities (LAs) have reported instances where they have received a new Universal Credit (UC) claim data share but a Housing Benefit (HB) Stop or HBMIG has not been received.

2. After investigations on individual claims, it is usually established the reason for non-receipt of the HB Stop or HBMIG is because the HB interest is not set on the claim.

3. LAs are reminded of the importance of ensuring Searchlight interest markers are kept up to date to ensure that claimants are correctly identified as being in receipt of HB.

LA action

4. If an LA receives a new claim data share, but a HB Stop or HBMIG has not been received, they should check Searchlight and ensure the HB interest is set.

5. If the HB interest is set, LAs should send details of the claimant’s name and National Insurance number to the Local Authority Security and Support Team (LASST) at [email protected] and we will recheck if the relevant Stop Notice has been issued.

6. If a Stop Notice has been issued, we will advise the LA to check with their IT department to understand why this has not downloaded.

7. If an LA identifies there is no HB interest set, they should set the interest and email details to LASST at the email address given above.

8. Do note, an HB Stop Notice cannot be reissued but LASST will be able to advise if the claimant has moved to UC through natural or managed migration. This will enable the LA to pay the correct amount of Transition to UC Housing Payment.

HB debt recovered by the Department for Work and Pensions’ Debt Management: Revision process for Capita and Civica users

9. From January 2025, the manual (workaround) revision process is moving to an automated revision process for all LAs using Capita and Civica supplier software.

10. All affected LA HB debt recovery teams must refer to the information and guidance placed on Glasscubes (within each software supplier’s folder). We will update Glasscubes regularly to reflect how the switchover and new process will work.

11. Do note, the change will not impact LAs using the NEC supplier software as the process is already automated.

New Performance Measurement HB work programme

13. The Department for Work and Pensions (DWP) Performance Measurement Team is responsible for measuring and reporting on the accuracy of DWP benefit payments; including benefits administered by LAs.

14. We do this by randomly sampling a set of cases from the live-load of the benefit. For HB this is done on a monthly basis with most LAs only coming up in one monthly sample, although some larger LAs appear in more than one.

Performance Measurement samples for the next work programme

15. Performance Measurement samples are manageable versions of a larger group from the HB live-load population. To ensure that the sampling provides information on different sub-groups, the sampling design is changed to drop elements from the current sample and replace them with a fresh sample. This approach ensures that we refresh information on the overall population gradually over time.

16. Performance Measurement will start the next work programme in November 2024 and:

  • the sample will be targeted to select standard and passported Pension age cases only.
  • LAs will receive this sample six to eight weeks ahead of the review for profile meetings and for LA software system prints to be provided to Performance Measurement.
  • we will aim to complete 3,000 reviews over a 12 month work programme.
  • a number of LAs have been consolidated into a single Primary Sampling Unit (PSU), this is to ensure the total sample is statistically valid at national level. Cases for review in these PSUs may be selected from one, multiple, or all the LAs in the PSU.
  • the data from these reviews will be included in the May 2026 national statistics.

New Pension Age Disability Payment and Scottish Adult Disability Living Allowance in Scotland

Pension Age Disability Payment

20. The Scottish Government’s Pension Age Disability Payment (PADP) opened for new applications in five Phase one local authority (LA) pilot areas from 21 October 2024.

21. Pension age adults with a disability or health condition, who are not already in receipt of Attendance Allowance, and living in one of the five Phase one pilot LA areas are the first to be able to apply.

22. Social Security Scotland will administer this new payment to replace Attendance Allowance, which is currently delivered by DWP.

23. The timeline for the introduction of PADP is as follows:

  • Phase one pilot: takes place in Aberdeen City, Argyll and Bute, Highland, Orkney and Shetland from 21 October 2024.
  • Phase two pilot: takes place in Aberdeenshire, Angus, Clackmannanshire, Dundee City, East Ayrshire, Falkirk, Fife, Moray, Na h-Eileanan Siar (Western Isles), North Ayrshire, Perth and Kinross, South Ayrshire and Stirling from 24 March 2025.
  • Applications will be open to every area in Scotland from 22 April 2025.

25. Claimants with ongoing awards of Attendance Allowance do not need to apply for PADP. Their awards will be transferred automatically to the new Scottish system, with no break in entitlement or payment. Further details on this will be shared when it becomes available.

Scottish Adult Disability Living Allowance

26. Scottish Adult Disability Living Allowance (SADLA) is a new benefit that replaces Disability Living Allowance (DLA) for Pension age people resident in Scotland.

27. It is a closed benefit. This means that there will be no new applications for SADLA, and only those with ongoing DLA in Scotland will be eligible to receive it. These claimants will have their DLA award transferred automatically to Social Security Scotland, with no break in entitlement or payment. Further details on this will be shared when it becomes available.

Impact on LAs

28. LAs should follow business as usual procedures and treat PADP and SADLA in the same way as they currently do with Attendance Allowance and DLA. For example, if a disability premium is payable on an HB claim because of a claimant’s DWP disability award, the same premium will be payable as a result of their Scottish disability benefit award.

29. LA IT software suppliers are making the required changes to HB systems and will provide further updates when this has been completed.

LA cyber security attacks

31. DWP has supported a large number LAs respond and recover from cyber security attacks. We are experienced in providing supportive, open and non-judgemental advice to LAs who have unfortunately suffered the consequences of cyber criminals.

32. LAs are reminded that as part of the data sharing Memorandum of Understanding (MOU) between DWP and LAs, they should notify DWP immediately as soon as they are aware there has been a cyber security attack on their systems. DWP may also receive intelligence about a suspected or confirmed cyber security attack directly through open source or intelligence agencies such as the National Cyber Security Centre. Following this intelligence, DWP will contact the impacted LA directly, offering our advice and support.

33. LAs should be aware that DWP may enact containment proceedings until the severity of the attack is known. We do this to prevent potential onward infection of DWP systems that are part of critical national IT infrastructure. This means that it is likely DWP will suspend access to DWP derived data until such times as the threat has been eradicated.

34. In the event of an attack (or suspected attack) there are some steps required by LAs to assure DWP it is safe to continue sharing data again. It is usually the expectation that LAs will provide an independent investigation report and undertake any additional assurance activities as directed by DWP to resume data sharing. DWP may request independent assurance from an accredited IT Health Check provider or Cyber Incident Response provider. LAs will be required to evidence how their software systems meet the security terms and conditions outlined within the MOU before access to DWP derived data will be restored.

35. DWP would support LAs throughout this process, providing advice on what must be included within the report, to return to business as usual. If you have any questions about the content of this article, please email [email protected]

Update: HB subsidy workshops

36. In October’s LAWD10/2024 we issued an invitation to register interest in attending the planned subsidy workshops due to be held early in 2025. Thank you to all who have already registered an interest. We have already had a high number or responses.

37. We continue to develop the planning for the workshops and, as a result, have made some changes to the content and structure outlined in that LAWD. To avoid confusion and duplication of information, the format of the ‘new to subsidy’ workshops has been revised and will no longer include information on any proposed changes to HB Assurance or subsidy claim process. The new sessions will focus on current procedures in respect of claim preparation and subsequent claim settlement and will include:

  • applicable timelines LAs need to adhere to each financial year
  • how estimates determine monthly subsidy payments
  • growth factors, exceptions and settlement of claims
  • a question and answer session.

38. The workshops for LA staff ‘experienced in subsidy’ will provide details of any proposed changes to the HB Assurance Process or subsidy claim process, including:

  • details of any planned changes
  • timing of changes
  • potential impacts of changes
  • changes to the reporting methods.

Invitation to the next Data sharing and IT consultation and engagement forum

40. The next forum will be held on Tuesday 3 December 2024 from 11am to 12 noon.

Joining instructions

41. The joining instructions are:

  • Note: The MS Teams link to this meeting has been shared in the version of the LAWD11/2024 that was sent directly to each LA’s single inbox - It is more difficult to ask questions through dial-in so, if you anticipate having questions, we recommend joining through MS Teams where possible.

  • aim to join the event two or three minutes before the start time, as we intend to start promptly.

  • speakers will be muted by default but instructions will be given during the event if you want to ask a question.

Forum agenda

  • A 15-minute introduction from DWP, covering projects recently delivered, projects currently in delivery, insight into future planned projects, as well as the most recent common issues that have been reported to us.

  • 30 to 45 minutes of questions from LAs on the call about the projects and matters covered in the introduction and any other IT and data sharing questions and issues LAs may have.

  • If time allows, 15 minutes focused on suggestions from LAs about future data sharing, data matching or automation projects that DWP could consider funding and delivering.

42. The call will be recorded and the recording will be placed on Glasscubes.

43. The forum is open to all LAs and it would be beneficial for every LA to have at least one representative dial into the forum to help us maximise feedback. Each LA representative should:

  • seek input and feedback from as many of their colleagues as possible prior to dialling in, for example, questions they might want answering.
  • have knowledge, at least at a high level, about data sharing, data matching and current IT topic areas.
  • feedback to their colleagues about how the conference call went, including the answers to the questions we asked.

Update: Move to UC

45. Throughout October 2024, we continued to move the remaining claimants to UC (including some claimants on income-based Employment and Support Allowance (ESA) and ESA with HB). We will shortly be commencing the migration of those tax credit claimants who have appointees which have been deferred until now.

46. A press release was published on Monday 7 October 2024 focusing on the fact there are only six months to go before tax credits closes. The article reminds those in receipt of tax credits that they do not need to take action until they receive a migration notice from DWP but once received, it’s important to act quickly.

47. We have also updated the guidance on www.gov.uk to include help for claimants to better understand how the transitional element is calculated when you move to Universal Credit

48. Money Saving Expert launched a new Move to UC Managed Migration guide in their weekly Money Tips email. This includes key information about the move and steps to take and urges claimants not to ignore their invitation to move over to UC. It also stresses that the move to UC isn’t automatic and that claimants must actively apply for UC within the three-month deadline set out in their migration notice letter.

Practitioners’ Operational Group and LA Welfare Steering Group        

49. The last Practitioners’ Operational Group meeting took place on 17 October 2024. Agenda items included LA funding and HB Subsidy Data Collection, Performance Measurement sampling, bringing the administration together for HB and Pension Credit, Move to UC and the Cost of Living.    

50. Both groups’ meetings are held bi-monthly (and alternately), so the next LA Welfare Steering Group meeting is scheduled to take place on 21 November 2024.

HB Decisions by the Upper Tribunal

52. Decision Making and Appeals (DMA) Leeds is not aware of any HB cases that have been decided by the Upper Tribunal (UT) since the last edition of the LAWD bulletin.
